IV. Time Limit
A. Application for the import and export of wildlife and its related
products will be examined and verified or be reported to a higher
body for examination and approval within fifteen days upon the receipt
of the application documents.
B. The Import and Export Certificate of Wildlife will be issued
to the applicant within 5 days upon the receipt of ratification
from the State Endangered Species' Import and Export Administration
and approval from other departments concerned.
V. Qualifications for Applicants
Establishments or individuals applying for the Import and Export
Certificate of Wildlife must meet the following qualifications:
A. Establishments or individuals applying for the Import and Export
Certificate of Wildlife for commercial purpose should have the power
of import and export on their own, have registered in the appropriate
wildlife administration at the provincial level or its authorized
administrative organs, and have been put on records and confirmed
by the State Endangered Species'Import and Export Administration;
B. Establishments or individuals applying for the Import and Export
Certificate of Wildlife for non-commercial purpose should have the
qualifications for wildlife training and breeding (cultivation),
scientific research, cultural exchange, publicity and education,
or have relevant documents for legal possession of wildlife specimens.
VI. Procedures for Application
A. Applicants shall supply certificates or documents that testify
their power of import and export on their own, certificates of origin
of the wildlife, contracts or agreements for the import and export
of wildlife (with notification of being ratified by relevant state
departments), and ratification from the State Endangered Species¡¯
Import and Export Administration and approval of other departments
concerned; [If the wildlife species to be imported are on the list
in the International Trade Convention of Endangered Wildlife Species
(hereinafter referred to as the Convention), applicants should also
supply the Import and Export Certificate of wildlife from the export
country as is required by the Convention.]
B. Applicants shall submit applications in written form for the
import and export of wildlife and its related products, in which
shall be labeled the species of the wildlife to be imported or exported
(including the Chinese, English and Latin names of the wildlife),
the commodity category, the quantity of the import or export, the
trading port, and the names of the consignor and the consignee;
C. Applicants shall fill out the Application Form for the Import
and Export Certificate of Wildlife and Its Related Products;
D. Applicants shall receive the standard Import and Export Certificate
of Wildlife printed and issued by the State Endangered Species¡¯
Import and Export Administration as is stipulated in the Convention
or the Import and Export Certificate of Wildlife specified by the
State after their applications are examined and approved by the
departments concerned.
VII. Business Procedures
A. Establishments or individuals applying for the Import and Export
Certificate of Wildlife should submit written applications to Shanghai
Agriculture & Forestation Bureau or the Representative Office
of the State Endangered Species¡¯ Import and Export Administration
in Shanghai, together with their necessary documents for application;
B. After being approved by Shanghai Agriculture & Forestation
Bureau or the Representative Office of the State Endangered Species'Import
and Export Administration in Shanghai, the applications shall be
reported to the State Endangered Species¡¯ Import and Export Administration
for examination and ratification;
C. The State Endangered Species¡¯ Import and Export Administration
or its Representative Office in Shanghai shall verify and issue
the Import and Export Certificate of Wildlife.
VIII. Standards for Charges
A. Management fees shall be calculated and levied on export of wildlife
for commercial purpose in accordance with the contract sum of the
export allowed. (Wild animals: 7% of the contract sum shall be levied
on species or their related products under the first-grade protection;
6% on species or their related products under the second-grade and
the third-grade protection; and 5% on other species of wild animals.
Cultivated animals: 3%, 2%, and 1.5% of the contract sum shall be
respectively levied on species or their related products under the
first-grade protection, species or their related products under
the second-grade and the third-grade protection, and other species
of cultivated animals. Wild plants: 4% of the contract sum shall
be levied on species or their related products under the first-grade
protection, 3% on species or their related products under the second-grade
and the third-grade protection, and 2% on other species of wild
plants. Cultivated plants: 2%, 1.5%, and 1% of the contract sum
shall be respectively levied on species or their related products
under the first-grade protection, species or their related products
under the second-grade and the third-grade protection, and other
species of cultivated plants. 0.5% of the contract sum shall be
levied on commodities that contain ingredients of wildlife.)
B. Management fees shall be calculated and levied on import of wildlife
for commercial purpose in accordance with the contract sum of the
import allowed. (1.5% of the contract sum shall be levied on the
wildlife imported; 0.5% of the contract sum shall be levied on commodities
that contain ingredients of wildlife.)
C. Management fees shall be calculated and levied on export of wildlife
for non-commercial purpose in accordance with the contract quantity
of the units of each export allowed. (RMB200 yuan shall be levied
on each exported animal or its related products under the first-grade
protection, RMB100 yuan on each exported animal or its related products
under the second-grade and the third-grade protection, and RMB50
yuan on each other species of animal. RMB30 yuan shall be levied
on each exported plant or its related product under the first-grade
protection, RMB20 yuan on each exported plant or its related product
under the second-grade and the third-grade protection, and RMB10
yuan on each other species of plant.)
D. Import, export or re-export without required certificates or
violation of what is stipulated in the required certificates shall
be levied a make-up management fee 2 to 5 times as much as the highest
standard set for import and export for commercial or non-commercial
purpose
